Implementation Rules for the Administrative Measures of Hebei Province on International Market Development Funds for Small and Medium-sized Enterprises

Chapter I General Provisions

Article 1 These Measures are formulated in accordance with the Notice of the Ministry of Finance and the Ministry of Commerce on Issuing the Administrative Measures for International Market Development Funds for Small and Medium-sized Enterprises (Cai Qi [2010] No. 87) to strengthen the management of international market development funds for small and medium-sized enterprises (hereinafter referred to as market development funds).
Article 2 The market development funds referred to in these Measures are special funds allocated by the central government to support various business activities of small and medium-sized enterprises in our province in exploring international markets.
Article 3 The management of market development funds follows the principles of openness and transparency, highlighting key priorities, special funds for special purposes, and focusing on practical results.
Article 4 Market development funds are jointly managed by the financial department and the commerce department.
The commerce department is responsible for the business management of market development funds, proposing support priorities, annual budgets, and fund allocation recommendations, and organizing project applications and reviews together with the financial department.
The financial department is responsible for the budget management of market development funds, reviewing and arranging fund support priorities and annual budgets, determining fund usage plans, handling fund disbursement, and conducting supervision and inspection of the use of market development funds together with the commerce department.

Chapter II Support Targets

Article 5 Projects where small and medium-sized enterprises independently explore international markets are enterprise projects; projects where enterprises, institutions, and social organizations (hereinafter referred to as project organizing units) organize small and medium-sized enterprises to explore international markets are group projects.
Article 6 Small and medium-sized enterprises applying for enterprise projects shall meet the following conditions:
00001. Registered within Hebei Province, legally obtained import and export business qualifications or legally completed registration for filing of foreign trade operators as a legal entity, with an annual import and export volume of less than 45 million USD according to customs statistics in the previous year;
00002. No illegal or non-compliant conduct in foreign trade business management, financial management, tax management, foreign exchange management, customs management, or other areas in the past three years;
00003. Have professional personnel engaged in international market development, with clear work arrangements and market development plans for expanding into international markets;
00004. No outstanding financial funds owed that should be returned.
Article 7 Project organizing units applying for group projects shall meet the following conditions:
00001. Have the qualification to organize enterprises or industries within Hebei Province to participate in or hold economic and trade exhibitions abroad;
00002. Have been reviewed and approved by management authorities to have the qualification to organize training for small and medium-sized enterprises;
00003. The group projects applied for should aim to support small and medium-sized enterprises in exploring international markets and enhancing their international competitiveness;
00004. No outstanding financial funds owed that should be returned.
Article 8 For approved group projects, small and medium-sized enterprises participating in such projects shall not repeatedly apply for market development fund support for the same project or content under the name of enterprise projects.

Chapter III Support Contents

Article 9 The main support contents of market development funds include: overseas exhibitions; management system certification; various product certifications; overseas patent applications; international market publicity and promotion; e-commerce; overseas advertising and trademark registration; international market research; overseas investment (bid) tendering; enterprise training; overseas acquisition of technology and brands, etc.
Article 10 Market development funds give priority support to the following activities:
00001. Expansion into emerging international markets such as Latin America, Africa, the Middle East, Eastern Europe, Southeast Asia, and Central Asia;
00002. Obtaining international certifications such as quality management system certification, environmental management system certification, and product certification

Chapter IV Fund Management

Article 11 After the central government allocates market development funds to our province, the Provincial Department of Finance and the Provincial Department of Commerce shall allocate them using methods such as the factor method, dividing them into portions for provincial use and portions for use by cities with districts and directly administered counties. The portions for use by cities with districts and directly administered counties shall be disbursed by the Provincial Department of Finance to the finance bureaus of cities with districts and directly administered counties.
Article 12: Provincial-level enterprise projects and project organizing units shall organize SMEs within the province to participate in overseas economic and trade exhibitions or training, and submit project applications to the Provincial Department of Finance and the Provincial Department of Commerce. After review and approval by the Provincial Department of Finance and the Provincial Department of Commerce, the market development funds shall be directly allocated to the project undertaking units.
Article 13: Enterprise projects and project organizing units in each districted city and directly administered county shall organize local SMEs to participate in overseas economic and trade exhibitions or training, and submit project applications to the local Finance Bureau and Commerce Bureau. The Finance Bureau and Commerce Bureau of the districted city or directly administered county shall, in accordance with these Measures, review and approve projects within their jurisdiction and allocate project funds, while simultaneously reporting the fund allocation documents to the Provincial Department of Finance and the Provincial Department of Commerce for filing.
Article 14: Market development funds shall provide support to projects that meet the provisions of Article 9 of these Measures and have expenditures of no less than 10,000 yuan. The support amount shall, in principle, not exceed 50% of the amount required for the supported content of the project. For projects meeting the provisions of Item 1 of Article 10 of these Measures, the support ratio may be increased to 70%.
Article 15: Market development funds obtained by SMEs shall be handled financially in accordance with relevant national regulations.
Article 16: Based on the needs of market development fund management, the Provincial Department of Finance and the Provincial Department of Commerce shall allocate relevant administrative expenses from the market development funds, used for hiring undertaking units, project review, evaluation, and auditing, etc. The expenditure ratio shall not exceed 3% of the total funds, and shall be strictly controlled and managed with frugality.
Article 17: The Finance Bureaus and Commerce Bureaus of each districted city and directly administered county shall annually summarize and evaluate the implementation of market development funds, and shall jointly report the fund settlement documents and fund summary reports to the Provincial Department of Finance and the Provincial Department of Commerce before the end of February of the following year. Financial and commerce departments at all levels shall properly keep the written materials submitted by SMEs and project organizing units, with a retention period of no less than 3 years.

Chapter 5 Supplementary Provisions

Article 18: The organization by SMEs or project organizing units of SME market development in Hong Kong, Macao, and Taiwan regions shall be implemented by reference to these Measures.

(II) Application Requirements for Overseas Exhibition Projects
1. Overseas exhibitions refer to international or regional comprehensive or specialized exhibitions held abroad, as well as various economic and trade exhibitions organized abroad with the approval of relevant Chinese authorities.
2. Overseas exhibition projects are divided into enterprise projects and group projects. Small and medium-sized enterprises or project organizing units should select the "Overseas Exhibition" category when applying.
3. Applications for overseas exhibition projects must include an invitation document from the exhibition organizer, and relevant procedures for foreign exchange, exit, and other related matters must be handled in accordance with national regulations.
4. For applications for overseas exhibition group projects, the project organizing unit must have the qualification to organize enterprises from the industry or region to hold economic and trade exhibitions abroad.
5. When applying for funding for group exhibition projects, the project organizing unit should provide a summary list of participating enterprises, with at least 10 (including 10) participating small and medium-sized enterprises.
