Notice of the Shanghai Municipal Commission of Commerce and the Shanghai Municipal Finance Bureau on Issuing the "Implementation Rules for the 2022-2023 National Foreign Economic and Trade Development Special Funds (Funds for Small and Medium-sized Enterprises to Explore International Markets)"

Article 1 (Purpose and Basis)
In accordance with the relevant provisions of the "Notice of the Ministry of Finance and the Ministry of Commerce on Issuing the Measures for the Administration of Special Funds for Foreign Economic and Trade Development" (Cai Jian [2022] No. 3, hereinafter referred to as the "Fund Management Measures") and the relevant requirements of the "Notice of the Ministry of Finance and the Ministry of Commerce on Key Work for Special Funds for Foreign Economic and Trade Development in 2022" (Cai Ban Jian [2022] No. 37, hereinafter referred to as the "Work Notice"), these Implementation Rules are hereby formulated in order to strengthen and standardize the use and management of the special funds for foreign economic and trade development (funds for small and medium-sized enterprises to explore international markets) and to support small and medium-sized enterprises in this city to actively explore international markets.
Article 2 (Source of Funds)
The special funds for foreign economic and trade development (funds for small and medium-sized enterprises to explore international markets) (hereinafter referred to as the "Market Development Funds") are special funds established by the central government to support small and medium-sized enterprises in exploring international markets.
Article 3 (Division of Responsibilities)
The Market Development Funds are jointly managed by the Shanghai Municipal Commission of Commerce (hereinafter referred to as the "Municipal Commerce Commission") and the Shanghai Municipal Finance Bureau (hereinafter referred to as the "Municipal Finance Bureau"). The district commerce authorities and the Municipal Undertaking Department for Funds for Small and Medium-sized Enterprises to Explore International Markets (hereinafter referred to as the "Municipal Undertaking Department") shall, according to their respective division of responsibilities, properly carry out the specific management of the special funds and other related work.
(1) The Municipal Commerce Commission, together with the Municipal Finance Bureau, mainly carries out the following work:
1. Determine the support directions and support standards of the special funds according to the development needs of relevant work in this city, and properly handle fund allocation and other matters.
2. Conduct departmental joint review of overseas exhibitions (group projects).
3. Supervising and inspecting the project review of district commerce authorities and municipal undertaking departments, and carrying out performance management of the development fund, etc.
4. Other related work required by the Ministry of Commerce and the Ministry of Finance.
(2) District commerce authorities mainly carry out the following work:
1. In accordance with the relevant provisions of these implementation rules, reviewing the application materials of enterprise projects, verifying the amount of project support, carrying out integrity management, etc., and performing final review responsibilities for enterprise-applied projects.
2. Responsible for publicity of development fund policies, policy consultation, etc.
3. Supervising and inspecting declared projects in the district, and properly carrying out performance management of the development fund, etc.
4. Other work related to the development fund.
(3) The Municipal Undertaking Department mainly carries out the following work:
1. Responsible for reviewing overseas exhibitions (group projects) and related matters.
2. Responsible for policy promotion and policy consultation on market development funds.
3. Cooperate with the Municipal Commerce Commission and the Municipal Finance Bureau in carrying out supervision and inspection of the review work of district commerce authorities and performance management of the Market Development Funds.
4. Other related work entrusted by the Municipal Commerce Commission.
Chapter 2 Support Directions and Application Review
Article 4 (Support Content and Standards)
The support content of the development fund includes: overseas exhibitions (divided into enterprise projects and group projects), management system certification, purchasing services such as overseas credit investigation and improving the level of scientific decision-making in business management, purchasing services such as export credit risk management and enhancing comprehensive risk management capabilities, etc. Support of no more than 50% of the actual expenditure amount shall be provided.
Article 5 (Support Targets)
(1) Enterprises applying for enterprise projects shall meet the following conditions:
1. The enterprise is a legal person registered with the industry and commerce administration in Shanghai, lawfully qualified for import and export operation or foreign economic cooperation operation, with an import and export volume under customs statistics of less than USD 65 million in the previous year. For enterprises that have been given development fund support in the past two years but still have no actual import and export performance, support shall generally no longer be provided.
2. Within the past three years, there have been no serious violations of laws and regulations, false reporting or concealment, fraudulent acquisition of special funds, repeated applications for the same project for financial funds, interception or misappropriation of special funds, etc., and no overdue repayment of financial funds that should be returned.
(2) Overseas exhibitions (group projects) shall meet the following conditions:
1. Organizing local enterprises to participate in exhibitions abroad with the approval of relevant national departments, or organizing local enterprises to participate in exhibitions abroad hosted by ministries, municipal departments, or relevant municipal-level departments upon entrustment by the Ministry of Commerce, the Shanghai Municipal Government, or relevant municipal-level departments.
2. The applying enterprise has no serious violations of laws and regulations, false reporting or concealment, fraudulent acquisition of special funds, repeated applications for the same project for financial funds, interception or misappropriation of special funds, etc. within the past three years, and has no overdue repayment of financial funds that should be returned.
